Can I file a second lawsuit for the same case?

In some car accident cases, a plaintiff either loses his or her case or doesn’t receive as much compensation as they had hoped for and may want to file a secondary lawsuit. Unfortunately, under the legal principle of res judicata, a plaintiff cannot file a secondary lawsuit if the case:

  • Deals with the same issues as the first claim
  • Deals with issues that could have been included in the first case
  • The plaintiff is looking for more money in the same settlement

To discuss how res judicata affects your case, contact a Rhinelander auto accident attorney of Habush Habush & Rottier S.C. at 800-242-2874 today and schedule a free consultation.
